- Das Vergaberecht der Europäischen Union ist derjenige Teil des Europarechts im engeren Sinne, der die Vergabe öffentlicher Aufträge durch die Mitgliedstaaten und deren Organe regelt. Es besteht im Wesentlichen aus der allgemeinen Vergaberichtlinie 2014/24/EU und der Sektorenrichtlinie 2014/25/EU sowie den vom EuGH erstmals in der Entscheidung Telaustria und Telefonadress zum Ausdruck gebrachten allgemeinen Rechtsgrundsätzen. - Government procurement or public procurement is undertaken by the public authorities of the European Union (EU) and its member states in order to award contracts for public works and for the purchase of goods and services in accordance with principles derived from the Treaties of the European Union. Such procurement represents 14% of EU GDP as of 2017, and has been the subject of increasing European regulation since the 1970s because of its importance to the European single market. According to a 2011 study prepared for the European Commission by PwC, London Economics and Ecorys, the UK, France, Spain, Germany, Poland and Italy were together responsible for about 75% of all public procurement in the EU and European Economic Area, both in terms of the number of contracts awarded through EU-regulated procedures and in value. The UK awarded the most contracts in value terms and France had the highest number of contracts. Although the United Kingdom left the EU on 31 January 2020, the existing regulations continued to apply until 31 December 2020 in accordance with the Brexit withdrawal agreement. (en)
- L'accordo quadro nel diritto dell'Unione europea è una tipologia di contratto utilizzata negli appalti pubblici che ha come principale caratteristica non il raggiungimento di un accordo completo, ma di sufficienti parti di esso per poter comunque proseguire nel rapporto demandando i dettagli a successive fasi del lavoro. Fu introdotto nella forma attuale a livello comunitario dalle direttive 2004/17/CE e 2004/18/CE del Parlamento europeo e del Consiglio, che riguardano, rispettivamente, le procedure di appalto dei cosiddetti settori speciali (es. gas, acqua, servizi di trasporto, postali) e le procedure di aggiudicazione degli appalti pubblici di lavori, forniture e servizi. In Italia, le due direttive sono state recepite nel Codice dei contratti pubblici. (it)
