- Το Δικαστήριο Γουαϊτάνγκι είναι δικαστήριο της Νέας Ζηλανδίας με την εξουσιοδότηση να αποζημιώνει Μαορί κατοίκους για γη που έχασαν είτε από απάτη ή βιαίως από το 1840. Εγκαθιδρύθηκε με Κοινοβουλευτική Πράξη το 1975, όταν οι διαμαρτυρίες για εκκρεμή παράπονα από τη Συνθήκη του Γουαϊτάνγκι είχαν αυξηθεί, ώστε να παρέχει μια νόμιμη διαδικασία με την οποία οι διεκδικήσεις της Συνθήκης Μαορί θα μπορούσαν να εξεταστούν. Η ερευνητική διαδικασία συμβάλει στην επίλυση διεκδικήσεων της Συνθήκης και, μ'αυτόν τον τρόπο, στην τακτοποίηση άλυτων θεμάτων μεταξύ των Μαορί και των (δηλ. μη-Μαορί). - Das Waitangi-Tribunal (Maori Te Rōpū Whakamana i te Tiriti) ist eine neuseeländische Untersuchungskommission, die Ansprüche der Māori untersucht, die sich aus dem Vertrag von Waitangi von 1840 ergeben. Das 1975 gegründete Tribunal entstand als Reaktion auf sich häufende Vorwürfe der Māori über den Umgang des neuseeländischen Staats mit ihren Ansprüchen. Das Tribunal kann Ansprüche jedes Māori untersuchen, der sich über eine Regierungshandlung oder das Unterlassen einer Handlung beschwert. Der Māori braucht dabei keine Legitimation als Vertreter einer Gruppe, das Tribunal kann allerdings offensichtlich unbegründete Ansprüche gleich zurückweisen. Im Gegensatz zu einem regulären Gericht verkündet das Tribunal bis auf wenige Ausnahmefälle keine bindenden Entscheidungen, sondern kann nur Empfehlungen vorlegen. Faktisch bindende Verhandlungen müssen die Māori mit dem Office of Treaty Settlements des neuseeländischen Staats durchführen. Sollte es sich beim umstrittenen Gebiet um Land in Privatbesitz handeln, kann es auch keine Empfehlungen vorlegen. Ausnahme ist hier Land, bei dem es sich um Memorialised Lands handelt – dies sind Gebiete, die sich ehemals im Besitz eines Staatsunternehmens oder der New Zealand Railways Corporation befunden haben und einen Vermerk besitzen, dass sie auf Anweisung des Tribunals in Staatsbesitz oder direkt in Besitz der Māori übergehen können. Der innere Ablauf des Tribunals weicht dabei in einigen Punkten entscheidend vom normalen Ablauf im anglo-amerikanischen Rechtswesen ab. Allerdings hat es die alleinige Autorität über die Auslegung des Vertrags von Waitangi, sowohl in seiner englischen als auch in der Māori-Fassung. Das Tribunal kann eigene Nachforschungen anstellen und ist nicht allein auf die Fakten angewiesen, die ihm von den beteiligten Parteien vorgelegt werden. Ebenso kann es seine eigenen Regeln sehr flexibel auslegen und sie je nach Situation an den vorliegenden Fall anpassen und dabei auch auf Rechtstraditionen der Māori zurückgreifen. (de)
- Le tribunal de Waitangi est un tribunal néo-zélandais chargé de dédommager les Maori pour leurs terres, dont ils ont été privées, par la fraude ou par la force, depuis 1840. Il a été créé par un acte du parlement en 1975, à une période où les protestations contre les griefs non résolus du Traité de Waitangi s'amplifiaient, pour fournir une procédure légale pour traiter les plaintes contre les violations du traité. Le but du tribunal est d'établir la validité des griefs, et ensuite de transmettre au gouvernement des recommandations pour permettre la restitution de terres saisies en violation du traité, ou bien une compensation financière. Environ la moitié des membres du tribunal sont Maori, et l'autre moitié sont donc Pakeha. Ceci reflète le partenariat entre Maori et Pakeha établi lors de la signature du Traité de Waitangi. (fr)
- The Waitangi Tribunal (Māori: Te Rōpū Whakamana i te Tiriti o Waitangi) is a New Zealand permanent commission of inquiry established under the Treaty of Waitangi Act 1975. It is charged with investigating and making recommendations on claims brought by Māori relating to actions or omissions of the Crown, in the period largely since 1840, that breach the promises made in the Treaty of Waitangi. The Tribunal is not a court of law; therefore, the Tribunal's recommendations and findings are not binding on the Crown. They are sometimes not acted on, for instance in the foreshore and seabed dispute. The inquiry process contributes to the resolution of Treaty claims and to the reconciliation of outstanding issues between Māori and Pākehā. In 2014, the Tribunal found that Ngāpuhi rangatira did not give up their sovereignty when they signed the Treaty of Waitangi in 1840. (en)
