- المادة 301 من قانون العقوبات التركي أو قانون إهانة الهوية التركية، هي مادة مثيرة للجدل في القانون التركي تجرم إهانة تركيا والقومية التركية ومؤسسات الحكومة التركية. تم تبني هذه المادة في 1 حزيران 2005. وكانت الفقرة الأصلية تنص على تجريم إهانة «الهوية التركية» أو «المشاعر التركية» غير أن تعديلا في 30 نيسان 2008 غير هذه الجملة إلى «الشعب التركي» على أساس أن هذا سيمنع استعمال هذا القانون لأغراض لم يسن من أجلها.تم رفع 60 دعوى قضائية بموجب هذا القانون منذ تبنيه، وحاز بعضها على اهتمام محلي ودولي واسع. ويعتبر «كمال كرنجز» رئيس نقابة المحاميين الأتراك مسؤولا عن رفع معظم هذه الدعاوى. - Article 301 is an article of the making it illegal to insult Turkey, the Turkish nation, Turkish government institutions, or Turkish national heroes such as Mustafa Kemal Atatürk. It took effect on June 1, 2005, and was introduced as part of a package of penal law reform in the process preceding the opening of negotiations for Turkish membership of the European Union (EU), in order to bring Turkey up to Union standards.The original version of the article made it a crime to "insult Turkishness"; on April 30, 2008, the article was amended to change "Turkishness" into "the Turkish nation". Since this article became law, charges have been brought in more than 60 cases, some of which are high-profile. The Great Jurists Union (Turkish: Büyük Hukukçular Birliği) headed by Kemal Kerinçsiz, a Turkish lawyer, is "behind nearly all of Article 301 trials". Kerinçsiz himself is responsible for forty of the trials, including the high-profile ones. On April 30, 2008 a series of changes were made on the Article 301, including a new amendment which makes it obligatory to get the approval of the minister of justice to file a case. This change was made to prevent the possible misuse of the article, especially against high-profile cases, filling up legal holes in the older version. (en)

È entrato in vigore il 1º giugno 2005 ed è stato introdotto come parte di un pacchetto di riforma del diritto penale nel processo che precede l'apertura dei negoziati per l'adesione della Turchia all'Unione europea (UE), al fine di portare la Turchia agli standard dell'Unione. La versione originale dell'articolo rendeva come crimine l'"insulto alla turchicità"; il 30 aprile 2008, l'articolo è stato emendato per cambiare "turchicità" in "nazione turca". Da quando questo articolo è diventato legge, sono state intentate accuse in più di 60 casi, alcuni dei quali di alto profilo. L'Unione dei Grandi Giuristi (in turco Büyük Hukukçular Birliği) guidata da Kemal Kerinçsiz, un avvocato turco, è "dietro quasi tutti i processi dell'articolo 301". Lo stesso Kerinçsiz è responsabile di quaranta dei processi, compresi quelli di alto profilo. Il 30 aprile 2008 sono state apportate una serie di modifiche all'articolo 301, tra cui un nuovo emendamento che rende obbligatoria l'approvazione del ministro della giustizia per la presentazione di una causa.
