- تعد حقوق الإنسان في أفغانستان موضع جدل خلاف؛ فبينما عرف عن طالبان انتهاكاتها التي لا تحصى لحقوق الإنسان، تستمر العديد من الانتهاكات لحقوق الإنسان في عهد الحكومة التي تلت طالبان. هذا وتملك أفغانستان إطارا قويا ومثيرا لحقوق الإنسان ضمن دستورها. يصون الفصل الثاني من دستور جمهورية أفغانستان الإسلامية وثيقة الحقوق، فحق الحياة والحرية محميان بالدستور وأيضا حق المحاكمة العادلة وافتراض البراءة لكل الأشخاص، وهذا ما يزود أفغانستان بإطار لحقوق الإنسان مضمون لكل المواطنين. ويذكر أن قوات الأمن الأفغانية ووكالة الاستخبارات اتهمتا بارتكاب انتهاكات صارخة لحقوق الإنسان كالاخفاءات القسرية والإعدامات بدون محاكمة واشتباهات بالتعذيب؛ كما تورطت قوات الأمن الأفغانية والقوى الجوية الأفغانية بقتل المدنيين في عمليات أرضية وبضربات جوية. - Human rights in Afghanistan have been violated by the Taliban administration since the Taliban takeover of Kabul in August 2021. The government has prevented most teenage girls from returning to secondary school education, and blocked women in Afghanistan from working in most sectors outside of health and education. Women have been ordered to wear face coverings in public, and barred from traveling more than 70 kilometres (40 mi) without a close male relative. The presidential government of the Islamic Republic of Afghanistan, which previously ruled Afghanistan, from 2004 until the Taliban overthrew it in 2021, had a strong human rights framework in its constitution. A bill of rights was enshrined in chapter two of the 2004 Constitution of Afghanistan. The right to life and liberty were constitutionally protected, as were the right to a fair trial and the presumption of innocence for all persons. That gave the Islamic Republic a strong human rights framework that was guaranteed to all citizens. In July 2022, Hibatullah Akhundzada, the Taliban's reclusive leader, lashed out at the criticism and demands of the international community on the Taliban's human rights restrictions, rejecting any negotiations or compromise on his "Islamic system" of governance. Nonostante i talebani fossero ben noti per numerose violazioni dei diritti umani inflitte ai cittadini afghani dal 1996 al 2001, numerose altre violazioni hanno continuato a verificarsi successivamente, nell'era del governo post-talebano. L'Afghanistan ha un quadro forte e interessante dei diritti umani all'interno della sua costituzione. Una carta dei diritti fondamentali è sancita nel secondo capitolo della costituzione della Repubblica Islamica dell'Afghanistan. Il diritto alla vita e alla libertà sono costituzionalmente protetti così come il diritto a un giusto processo e la presunzione di innocenza per tutte le persone, ciò conferisce alla Repubblica islamica dell'Afghanistan un solido quadro di diritti umani garantito a tutti i cittadini. Le forze di sicurezza afghane e la loro agenzia di intelligence sono state accusate di aver commesso gravi violazioni dei diritti umani come sequestri di persona, esecuzioni extragiudiziali e tortura ad alcuni sospettati. Inoltre, anche le forze di sicurezza afghane e l'aviazione afghana sono state coinvolte nell'uccisione di civili in operazioni di terra e in attacchi aerei. (it)
