  • A court hearing an application for an order for possession by a lender should be satisfied that the lender complied with the moratorium on seeking possession in certain circumstances imposed by the Code of Conduct on Mortgage Arrears. Where such an application for possession has been brought in circumstances in clear breach of a moratorium, the court should decline to make the order. However, failure by a lender to comply with other provisions of the Code of Conduct on Mortgage Arrears will not, as a matter of law, affect the relevant lender’s entitlement to obtain an order for possession.
