- The copyright law of Chile is governed by Law No. 17,336, on Intellectual Property of October 2 of 1970 and subsequent amendments. It was implemented in the Decree No. 1122 of the Ministry of Education of Chile on May 17 of 1971. This law aims to protect the economic and moral rights of Chilean authors and foreigners residing in Chile, granted by the mere fact of creating works that are literary, artistic and scientific. It states that foreign authors who aren't domiciled in the country enjoy the protection that is recognized by the international conventions that Chile has signed and ratified. (en)
- La Ley Nº 17.336, sobre Propiedad Intelectual, de 2 de octubre de 1970, y sus modificaciones posteriores regulan el derecho de autor en Chile. Esta ley pretende proteger los derechos que, por el solo hecho de la creación de una obra, adquieren los autores de obras de la inteligencia en los dominios literarios, artísticos y científicos, cualquiera que sea su forma de expresión, y los derechos conexos que ella determina. De acuerdo con la misma, el derecho de autor comprende los derechos patrimoniales y morales, que protegen el aprovechamiento, la paternidad y la integridad de una obra. Esta ley ampara los derechos de los autores chilenos y extranjeros domiciliados en Chile. Establece, asimismo, que los autores extranjeros no domiciliados en el país gozan de la protección que les sea reconocida por las convenciones internacionales que Chile ha suscrito y ratificado. Las obras que se encuentran protegidas son, en general, las de tipo literario, artístico y científico. A modo ejemplar, la ley establece en su artículo 3º una enumeración no taxativa de las obras especialmente protegidas, entre otras, menciona a los libros, las ilustraciones, las películas y los programas informáticos. - Le droit d'auteur au Chili est l'ensemble des droits exclusifs dont dispose un auteur sur les œuvres de l'esprit au Chili. Il est réglementé par la loi du 2 octobre 1970, modifiée par la loi 19 928 de 2004. Cette législation regroupe le droit d'auteur et les droits voisins du droit d'auteur. Il existe une législation différente qui traite des brevets et de la propriété industrielle. Les simples idées sont exclues de la protection des brevets. Le Chili a adhéré à la Convention de Berne pour la protection des œuvres littéraires et artistiques, à la Convention universelle sur le droit d'auteur, ainsi qu'à la Convention interaméricaine sur le droit d'auteur du 22 juin 1946. - Авторское право Чили регулируется законом № 17,336 о интеллектуальной собственности от 2 октября 1970 года и последующими поправками. Он был реализован в постановлении № 1122 в Министерство образования Чили 17 мая 1971 года. Этот закон направлен на защиту экономических и моральных прав чилийских авторов и иностранцев, проживающие в Чили, при факте создания ими литературных, художественных и научных произведений. В законе говорится, что иностранные авторы, кто не проживает в стране, пользуются защитой, которая признана международным конвенциями, если Чили подписала и ратифицировала эти конвенции. (ru)
