Im deutschen Recht kann grobe Fahrlässigkeit und Vorsatz nicht von einer Haftung ausgeschlossen werden. Gemäß § 276 BGB muss der jeweilige Autor eine zulässige mindere Haftung rechtswirksam vereinbaren, und gemäß § 276 Abs.  3 BGB kann die Haftung wegen Vorsatz nicht im Voraus erlassen werden. Der Haftungsausschluss in der original Lizenz ist jedoch zu allgemein formuliert und dadurch vollständig unwirksam. Somit ist auch einfache Fahrlässigkeit nicht von der Haftung ausgeschlossen.
