Despite allegations that race, gender, and class bias influenced his lenient sentencing of Turner (prosecutors had asked for six years), the California Commission on Judicial Performance found no wrongdoing in their investigation of the case. Nonetheless, Persky was recalled by voters on June 5, 2018, during the 2018 California primary elections. Prior to joining the bench, he practiced civil litigation for five years and was a prosecutor in Santa Clara County for six years. He also briefly coached girls' tennis at Lynbrook High School in the fall of 2019.
