- Le Privilège de secret d'État (State Secret Privilege) est une règle juridique aux États-Unis restreignant l'usage des preuves, créée par la règle du précédent. De façon générale, c'est une règle de common law, ayant été aux États-Unis depuis le droit britannique. Elle consiste à écarter des preuves lorsque la sécurité nationale est en jeu, sans que le tribunal ne puisse, la plupart du temps, examiner la validité du prétexte invoqué. Cependant, la règle a été de plus en plus souvent utilisée pour écarter non seulement des preuves, mais la totalité d'une affaire, terminant ainsi par un non-lieu. À la suite de l'usage fréquent par l'administration Bush de ce privilège, le Parti démocrate a présenté en 2008 une proposition de loi, le (en), visant à limiter les cas d'invocation de ce privilège, tandis qu'Eric Holder, l'attorney general du président Barack Obama, a annoncé une révision de la politique de l'exécutif vis-à-vis du secret d’État afin de restreindre les cas d'invocation de cette règle. - The state secrets privilege is an evidentiary rule created by United States legal precedent. Application of the privilege results in exclusion of evidence from a legal case based solely on affidavits submitted by the government stating that court proceedings might disclose sensitive information which might endanger national security. United States v. Reynolds, which involved alleged military secrets, was the first case that saw formal recognition of the privilege. Following a claim of "state secrets privilege", the court rarely conducts an in camera examination of the evidence to evaluate whether there is sufficient cause to support the use of this doctrine. This results in court rulings in which even the judge has not verified the veracity of the assertion. The privileged material is completely removed from the litigation, and the court must determine how the unavailability of the privileged information affects the case. (en)
