La jurisprudence actuelle montre un élargissement de la notion de « vie privée et familiale » qui bénéficie principalement aux étrangers mais aussi dans une certaine mesure aux personnes LGBTQIA+. En effet, si la Cour reconnait l’existence d'une vie familiale dans un couple homosexuel, elle n'impose pas aux États de réaliser une égalité de traitement avec les couples de sexe différent et notamment dans le domaine du mariage.
