- A patent application is a request pending at a patent office for the grant of a patent for an invention described in the patent specification and a set of one or more claims stated in a formal document, including necessary official forms and related correspondence. It is the combination of the document and its processing within the administrative and legal framework of the patent office. To obtain the grant of a patent, a person, either legal or natural, must file an application at a patent office with the jurisdiction to grant a patent in the geographic area over which coverage is required. This is often a national patent office, but may be a regional body, such as the European Patent Office. Once the patent specification complies with the laws of the office concerned, a patent may be granted for the invention described and claimed by the specification. The process of "negotiating" or "arguing" with a patent office for the grant of a patent, and interaction with a patent office with regard to a patent after its grant, is known as patent prosecution. Patent prosecution is distinct from patent litigation which relates to legal proceedings for infringement of a patent after it is granted. (en)
- Une demande de brevet est une requête déposée par une personne, appelée demandeur, auprès d'un office des brevets pour la délivrance d'un brevet d'invention. Une demande de brevet contient généralement, outre la requête elle-même, une description de l'invention ainsi que des informations relatives au demandeur. Les termes demandes de brevet réfèrent également à cette description de l'invention. La délivrance du brevet relève de la compétence de l'office des brevets auprès duquel la demande a été déposée. Il peut s'agir d'un bureau national, comme l'INPI pour la France ou l'USPTO pour les États-Unis. Il peut également s'agir d'un bureau régional officiant pour plusieurs États, comme l'Office européen des brevets ou encore l'OAPI. Le brevet étant un titre associé à un territoire national, la demande de brevet déposée auprès d'un bureau régional sera unique jusqu'à la délivrance du brevet, lequel éclatera alors en autant de brevets nationaux que d'États pour lesquels le demandeur souhaite une protection. L'instruction de la demande par l'office auprès duquel elle a été déposée est appelée procédure de délivrance. Cette procédure consiste à examiner si la demande de brevet est conforme, tant sur le fond que sur la forme, au droit de la propriété industrielle du ou des pays pour lesquels une protection est recherchée. La demande de brevet comporte généralement un bref abstract.
