A probate court (sometimes called a surrogate court) is a court that has competence in a jurisdiction to deal with matters of probate and the administration of estates. In some jurisdictions, such courts may be referred to as Orphans' Courts or courts of ordinary. In some jurisdictions probate court functions are performed by a chancery court or another court of equity, or as a part or division of another court.

September 2009 in Deutschland geltenden Gesetz über das Verfahren in Familiensachen und in den Angelegenheiten der freiwilligen Gerichtsbarkeit (FamFG) ist örtlich das Amtsgericht als Nachlassgericht am letzten gewöhnlichen Aufenthalt des Verstorbenen (§ 343 FamFG, § 23a GVG) zuständig. Für Ausschlagungen besteht seit 1. September 2009 zusätzlich eine besondere Zuständigkeit des Nachlassgerichts, in dessen Bezirk der Ausschlagende seinen gewöhnlichen Aufenthalt hat (§ 344 Abs. 7 FamFG). Abweichend davon waren in Baden-Württemberg gemäß § 38 des Landesgesetzes über die freiwillige Gerichtsbarkeit bis zum 31. Dezember 2017 die staatlichen Notariate als Nachlassgerichte zuständig.
