- Legal fake is a phenomenon in the fashion industry wherein a third company precedes the original brand company in the registration of the trademark, running its own business, from production to sales, in another country. By exploiting the products, creativity, marketing and advertising strategies of the original brand, the company misleads consumers, who are not aware of the fake goods. Thus, its typical traits lay upon the question of intellectual property, trademark registration laws among different countries, advertising strategies and consumer behaviour. Legal fake, like all contradictions in terms, uses auto-antonym to illustrate a rhetorical point. Legal fake is not a legal term and should not be confused with counterfeit. Although it replicates the original products, its aim is to create a new business parallel to that of the original brand, proposing itself as an authentic brand. Compared to counterfeit products, legal fakes exploit brands that are well-known only to specific groups of people. (en)
- Si definisce Legal Fake (tradotto dall'inglese, «falso legale») il fenomeno tramite il quale un'azienda registra e produce per proprio conto dei prodotti utilizzando nomi e loghi commerciali di proprietà di una seconda azienda, senza l'autorizzazione di quest'ultima e in paesi nei quali questa non ha ancora commercializzato o registrato il proprio marchio. È un fenomeno abbastanza recente, che ha coinvolto specialmente il settore della moda, in particolare lo street wear e lo stile correlato alla sottocultura dello skateboarding. Il Legal Fake non è da confondersi con la contraffazione propriamente detta. Infatti, mentre quest'ultima è spesso legata al mercato nero, nel caso del Legal Fake i prodotti possono essere venduti e acquistati legalmente (almeno prima di un'eventuale sentenza di un tribunale). Inoltre le aziende produttrici di Legal Fake non sono interessate a imitare il marchio per frodare i consumatori, ma piuttosto a sostituirsi al brand originale e ad "impersonarlo". (it)
