- Rhode Island was one of the earliest states in the United States to abolish capital punishment, having abolished it for all crimes in 1852. The death penalty was reintroduced in 1872, but it was never carried out before being abolished again in 1984. Of all the states, Rhode Island has had the longest period with no executions, none having taken place since 1845. Rhode Island performed 52 executions from 1673 to 13 February 1845, but only eight took place after statehood. Half of the executions occurred on 19 July 1723, when 26 sailors were hanged for piracy. Rhode Island has never executed a female offender. Hanging was the most commonly used form of execution; five executions were carried out by an unknown method. Gas chambers were authorized after 1973, but were never used. In 1984, Rhode Island established law current with the United States Constitution that capital punishment is a form of cruel and unusual punishment and is illegal. (en)

Après une première abolition, elle fut toutefois réintroduite en 1872 pour les meurtres commis par un condamné à une peine d'emprisonnement à perpétuité, mais cette loi ne fut jamais utilisée durant ses cent ans d'existence (la dernière exécution, celle de John Gordon, date de 1845). La chambre à gaz fut adoptée en 1973 comme mode d'exécution secondaire pour meurtre commis dans un établissement pénitentiaire par un détenu, mais ne fut cependant jamais utilisée car cette nouvelle loi fut déclarée anticonstitutionnelle l'année précédente par la Cour suprême des États-Unis. La peine de mort fut à son tour déclarée anticonstitutionnelle par la Justice du Rhode Island en 1982 à cause de son caractère automatique.
