Directive 98/44/EC of the European Parliament and of the Council of 6 July 1998 on the legal protection of biotechnological inventions is a European Union directive in the field of patent law, made under the internal market provisions of the Treaty of Rome. It was intended to harmonise the laws of Member States regarding the patentability of biotechnological inventions, including plant varieties (as legally defined) and human genes.

- La Directive 98/44/CE du Parlement européen et du Conseil du 6 juillet 1998 relative à la protection juridique des inventions biotechnologiques, adoptée sur la base de l’article 95 TCE sur l’harmonisation du marché intérieur, vise à définir une approche commune de l'attribution des brevets liés aux biotechnologies (notamment les plantes et les gènes d'origine humaine) dans l'Union européenne, mais n'est pas une loi bioéthique à proprement parler, domaine pour lequel l'Union n'a pas compétence. Fait relativement rare, la Commission européenne a cependant introduit certaines notions éthiques dans un texte juridique, sans pour autant influer sur la valeur normative et technique de celui-ci : les considérants introductifs à la directive ont ici une énorme valeur explicative, et aident à limiter les éventuels problèmes d’interprétation qui pourraient survenir. Cette évolution est liée au rejet d'une première version par le Parlement européen en 1995. (fr)
