- Die Entscheidung des High Court of Australia in der Sache Mabo and Others versus Queensland (No. 2) von 1992, meist zitiert als Mabo v. Queensland (No. 2), ist eine Leitentscheidung zum Rechtsstatus indigener Völker innerhalb des Commonwealth of Australia. Ihr war 1988 die Entscheidung Mabo and Another v. The State of Queensland and Another, kurz Mabo v. Queensland (No. 1), vorangegangen. Die Entscheidung stellt klar, dass schon vor der britischen Kolonisation Australiens die dortigen Urvölker eine Art Territorialherrschaft über ihr jeweiliges Gebiet besaßen und bei der Kolonisation somit nicht ausschließlich Terra Nullius vorlag. Zwar könnte die ursprüngliche Art der Territorialherrschaft nach Okkupation durch den neuen Souverän modifiziert oder gänzlich ersetzt werden, doch sei dazu ein zielgerichteter Akt des Staates nötig. Estableció la anulación del concepto de terra nullius, o «tierra de nadie», que había estado vigente desde el comienzo de la colonización británica en 1788, y reconoció una forma de native title. La decisión de la Corte Suprema anulaba una sentencia previa de la Corte Suprema del Territorio del Norte, sobre una demanda territorial interpuesta por los isleños del estrecho de Torres Eddie Mabo, David Passi y James Rice, de las . - Mabo v Queensland (No 2) (commonly known as Mabo) is a decision of the High Court of Australia, decided on 3 June 1992. It is a landmark case, brought by Eddie Mabo against the State of Queensland. The case is notable for first recognising the pre-colonial land interests of Indigenous Australians within Australia's common law. Mabo is of great legal, historical, and political importance to Aboriginal and Torres Strait Islander Australians. The decision rejected the notion that Australia was terra nullius at the time of British settlement, and recognised that Indigenous rights to land existed by virtue of traditional customs and laws and these rights had never been wholly been lost upon colonisation. The Prime Minister Paul Keating praised the decision, saying it "establishes a fundamental truth, and lays the basis for justice". Conversely, the decision was criticised by the government of Western Australia and various mining and pastoralist groups. Native title doctrine was eventually codified in statute by the Keating Government in the Native Title Act 1993. This recognition enabled further litigation for Indigenous land rights in Australia.
