- Das Einheitliche Patentgericht (EPG) ist ein geplanter Gerichtshof mit zwei Instanzen für Streitigkeiten, die das europäische Patent (einschließlich des Einheitspatents) betreffen. Dieses Gericht wird grundsätzlich (vorbehaltlich der Möglichkeit des opt-out) für Nichtigkeitsklagen gegen Europäische Patente einschließlich der Einheitspatente, für Klagen wegen deren Verletzung und für Klagen gegen das Europäische Patentamt wegen der Zurückweisung des Antrags auf Registrierung des einheitlichen Patentschutzes zuständig sein. Die Möglichkeit des Einspruchs gegen das Europäische Patent innerhalb von neun Monaten nach dessen Erteilung bleibt hiervon unberührt. Aufgrund des Brexit und der inzwischen abgeschlossenen Verfahren vor dem deutschen Bundesverfassungsgericht war die Zukunft des EPG zunächst unklar. Wegen des Brexit fiel der ursprünglich vereinbarte Standort im Vereinigten Königreich (London) weg. Damit das Gericht die Arbeit aufnehmen kann, muss das Übereinkommen über ein Einheitliches Patentgericht (EPGÜ) von 13 Staaten der EU, darunter Deutschland, Frankreich und (bis zum Brexit) das Vereinigte Königreich, ratifiziert werden. Die Ratifizierung durch die Bundesrepublik Deutschland ist innerstaatlich seit Herbst 2021 anschließend vorbereitet, aber das Ratifikationsinstrument wurde noch nicht deponiert. Das Vereinigte Königreich verkündete am 27. Februar 2020, dass es trotz Ratifizierung nicht am Einheitspatent-System und dem Einheitlichen Patentgericht teilnehmen wird und widerrief die Ratifikation formell am 20. Juli 2020. (de)
- La juridiction unifiée du brevet est une cour de l'Union européenne issue d'un accord entré en vigueur en février 2013 et signé par vingt-cinq États membres de l'Union européenne. Lorsque l'accord l'ayant créé sera ratifié conformément aux dispositions prévues par le traité, la Cour pourra connaître des affaires concernant les procédures d'infraction et de révocation des brevets européens en vigueur dans les États participants à la coopération renforcée. L'accord relatif à une juridiction unifiée du brevet a été signé par vingt-cinq États membres (tous, sauf la Croatie, qui a adhéré à l'Union après la signature de l'accord, l'Espagne et la Pologne) mais n'est jamais entré en vigueur. Une fois établie, la Cour permettra de supprimer les difficultés liées au lancement de procédures d'infractions de brevets européens séparément, dans chaque État. La juridiction se composera d'une Cour de première instance, d'une juridiction d'appel et d'un greffe commun. - The Unified Patent Court (UPC) is a common patent court open for participation of member states of the European Union, and created by the "Agreement on a Unified Patent Court" (UPC Agreement or UPCA), which is provisionally applicable since 19 January 2022. Once the UPC Agreement will be in force, the UPC will hear cases regarding infringement and revocation proceedings of European patents (including unitary patents) that are valid in participating member states. A single court ruling will be directly applicable in the member states that have ratified the UPC Agreement. The UPC Agreement was signed as an intergovernmental treaty in February 2013 by 25 states (all EU member states except Spain, Poland and Croatia). It will enter into force on the first day of the fourth month after meeting . Provisional application of the UPC Agreement was triggered on 19 January 2022 to enable preparation for the proper functioning of the court after entry into force. While the United Kingdom originally ratified the agreement, it withdrew from the UPC in 2020, following Brexit. The UPC comprises a Court of First Instance, a Court of Appeal in Luxembourg, an Arbitration and Mediation Center and a common Registry. The Court of First Instance consists of a central division in Paris (with a thematic section in Munich and possibly a third city as replacement for London), along with 13 local and one regional divisions. Requesting European patents with unitary effect which apply in all countries where the UPC Agreement is in force upon the grant of European patents will be possible from the entry into force of the Unified Patent Court Agreement.
