- ينص دستور إيطاليا فقط على نوعين من الاستفتاءات الملزمة قانوناً:
* استفتاء تشريعي: و الذي لا يمكن أن يدعى له إلا من أجل اتخاذ قرار حول إلغاء كلي أو جزئي لقانون حالي.
* استفتاء دستوري: و الذي يدعى له لاتخاذ قرار حول الموافقة على قانون أو تعديل دستوري. على الرغم من الحق القانوني في إجراء استفتاء تشريعي قائم منذ تمت الموافقة على الدستور الإيطالي في عام 1947، فإن التشريعات الضرورية التي تفصل الإجراءات البيروقراطية اللازمة لم تتم الموافقة عليها حتى أوائل السبعينات. نتيجة لهذا لم يجر الاستفتاء الشعبي الأول في إيطاليا حتى عام 1974 بعد 27 عاما من الموافقة على الدستور الأول. أجري الاستفتاء الدستوري الأول في عام 2001 بعد 54 سنة من الموافقة على الدستور. - Die Verfassung der Italienischen Republik gestaltet diese als parlamentarische Demokratie, was bedeutet, dass das Volk seine Souveränität prinzipiell mittelbar über Volksvertreter (die Kammern sowie die regionalen Volksvertretungen) ausübt. Dieses Prinzip wird allerdings in bestimmten Bereichen durchbrochen; obwohl die Verfassungsgebende Versammlung insgesamt sehr sparsam mit den Instrumenten der direkten Demokratie umgegangen ist, hat sie dem Volk in bestimmten, als sehr sensibel erachteten Bereichen eine direkte Mitwirkung zugestanden. - A referendum, in the Italian legal system is a request directed to the whole electorate to express their view on a determined question. It is the main instrument of direct democracy in Italy. The Constitution of Italy only provides for four types of legally binding referendums:
* A popular referendum, in which the electorate is called to vote on whether they wish to abolish (abrogate) an existing law, either totally or partially.
* A constitutional referendum, which can be requested in some cases when a new constitutional law is approved by Parliament. Similarly, a referendum can be requested to confirm the adoption of the Statute of ordinary regions.
* An advisory referendum is required to approve the modification of regions, provinces, or municipalities.
* A popular referendum on regional laws and regulations may be regulated by regional statutes. Despite that the constitutional right to hold a popular referendum has existed since adoption of the Constitution in 1948, the necessary legislation detailing the bureaucratic procedures needed to hold them was not adopted until the early 1970s. As a consequence of this, Italy's first popular referendum was not held until 1974, 27 years after the constitution was first approved. (en)

È uno degli strumenti, insieme alla petizione (Art.50 Cost.) e al disegno di legge di iniziativa popolare (Art. 71 Cost.), con i quali è garantita la partecipazione diretta dei cittadini alla vita politica del Paese, considerata (ex art. 3 Cost.) quale diritto inviolabile.
