  • Ústava Spojených států amerických (anglicky Constitution of the United States of America) je základní zákon Spojených států amerických. Je základním rámcem pro organizaci moci ve Spojených státech a pro vztah mezi jednotlivými složkami moci, občany a všemi lidmi na území Spojených států. Ústava Spojených států amerických (dále jen Ústava) stanovuje republikánské zřízení se třemi pilíři státní moci: mocí zákonodárnou, představovanou dvoukomorovým Kongresem, mocí výkonnou, jejímž hlavním představitelem je prezident, a mocí soudní, na jejímž vrcholu stojí Nejvyšší soud, a také specifikuje dosah a povinnosti každé ze jmenovaných složek moci. První americkou ústavou byly tzv. Články Konfederace a trvalé unie, které však dávaly centrální vládě jen velmi omezenou moc. Jimi ustanovený Kontinentální kongres trpěl trvale nedostatkem financí, což prakticky znemožňovalo jeho akceschopnost. Nová ústava, jejímž hlavním účelem bylo umožnit vytvoření silnější centrální vlády, byla přijata 17. září 1787 na ústavním konventu ve Filadelfii v Pensylvánii a „ve jménu lidu“ ratifikována konventy v každém státě. K Ústavě bylo dosud přijato celkem 27 dodatků, z nichž prvních deset je známo jako tzv. Listina práv. Způsob, jakým je Ústava včetně svých dodatků chápána, do velké míry závisí nejen na jejím textu samotném, ale také na rozhodnutích Nejvyššího soudu učiněných v soudních sporech týkajících se jejích ustanovení. Nejvyšší soud má také pravomoc přezkoumávat a případně i rušit federální zákony či zákony jednotlivých států, pokud je shledá neústavními. Ústava Spojených států amerických je považována za nejstarší stále platnou psanou ústavu na světě. Je ústředním bodem amerického práva a americké politické kultury.   • Die Verfassung der Vereinigten Staaten von Amerika (englisch United States Constitution), die am 17. September 1787 verabschiedet wurde und durch die Ratifizierung in New Hampshire am 21. Juni 1788 (als 9. Staat) am 4. März 1789 in Kraft trat, legt die politische und rechtliche Grundordnung der USA fest. Sie sieht eine föderale Republik in Form eines Präsidialsystems vor. Die Verfassung wurde von Delegierten aus zwölf der dreizehn Gründerstaaten der USA erarbeitet, die in der Philadelphia Convention zusammengetreten waren. Sie löste die zuvor geltenden Konföderationsartikel ab und etablierte eine starke Zentralgewalt mit einem Präsidenten an der Spitze, der sowohl Staats- als auch Regierungschef ist. Zugleich schreibt sie eine als „Checks and Balances“ bezeichnete Gewaltenteilung vor, in der die Organe der Regierung, der Gesetzgebung und der Rechtsprechung getrennt voneinander agieren und sich durch weitreichende Verschränkungen gegenseitig kontrollieren. Wcześniejsza jest jednak od niej Konstytucja Korsyki, która jest jednak bardzo krótka i częściowa. Konstytucja Stanów Zjednoczonych była wzorem dla wielu innych konstytucji powstających na całym świecie. Jej siłą jest prostota i elastyczność. Obecnie, z 27 poprawkami, służy ponad 300 milionom Amerykanów w 50 stanach, które są w wielu kwestiach różne. Konstytucja jest sztywna, choć wrażenie to może zachwiać fakt, iż należy do konstytucji otwartych. Wskutek tego jest bardzo ogólnikowa (normuje tylko zasady ustroju państwa, konkretną treść otrzymują one albo w drodze wykładni sądowej, albo w praktyce ich stosowania przez organy państwowe), a prawa w niej zawarte można interpretować na wiele sposobów (interpretacji dokonują władze federalne). Jej sztywność polega zaś na ogromnie trudnej procedurze jej zmienienia. Odbyć się to bowiem może jedynie na wniosek 2/3 głosów obu izb Kongresu Stanów Zjednoczonych lub specjalnej Konwencji dla zaproponowania poprawek (która to Konwencja zostaje zwołana przez zobowiązany do tego Kongres w przypadku wniosku co najmniej 2/3 wszystkich stanów). Potem 3/4 stanów musi te zmiany zaakceptować (w jednakowo określony dla wszystkich stanów sposób: poprzez stanowe ciała ustawodawcze lub specjalne stanowe konwencje ratyfikacyjne).
