Cushing war 1788 Vizepräsident der Versammlung, die für den Bundesstaat der Verfassung der Vereinigten Staaten zustimmte. George Washington nominierte ihn am 24. September 1789 als Richter am Obersten Gerichtshof; der Senat bestätigte ihn zwei Tage später. Er wird den Föderalisten zugerechnet. Eines der wichtigsten Urteile unter seiner Beteiligung war Chisholm v. Georgia, in dem die Klage eines Bürgers gegen einen Bundesstaat vor einem Bundesgericht für zulässig erklärt wurde. 1793 nahm Cushing George Washington den Amtseid ab. 1796 wurde er als Oberster Richter der Vereinigten Staaten nominiert und vom Senat bestätigt.
