En un principio se dedicó a ejercer la profesión en forma privada, pero con el comienzo de la Segunda Guerra Mundial, Hart ingresa a trabajar en el Servicio de Inteligencia Británico (MI5), donde compartió labores con otros filósofos oxonienses como Gilbert Ryle y Stuart Newton Hampshire. Con el fin de la contienda, Hart pasa a desempeñarse como académico en Oxford, donde detentó la cátedra de Jurisprudence. Fue profesor visitante en varias universidad estadounidenses, y principal de Brasenose College. En 1959 publica, junto con A. M. Honoré, Causation in Law; mientras que en 1961 publica su trabajo más importante: The concept of law. Hart se enrola dentro de la llamada Analytical jurisprudente, corriente del positivismo para la cual el análisis del lenguaje resulta un elemento fundamental a fin de una mejor comprensión del derecho.

Tra le norme secondarie spiccano la Norma di riconoscimento, a valore lato sensu consuetudinario, che rappresenta la testata d'angolo dell'intero sistema giuridico; la Norma di Mutamento, che permette a soggetti stabiliti di creare nuove norme, e la Norma di Giudizio, che permette di istituire tribunali per la verifica della commissione di illeciti. Dato che non tutte le norme impongono comportamenti da tenere (solo le primarie seguono questo schema), una delle più importanti conseguenze della teoria di Hart è la negazione della necessità concettuale della presenza della sanzione all'interno dello schema normativo.
