  • The Fixed Book Price Agreement (FBPA) is a form of resale price maintenance applied to books. It commonly takes the form of an agreement between publishers and booksellers which set the prices at which books were to be sold to the public. An example of FBPA was the former Net Book Agreement in the United Kingdom. The key idea of the FBPA is to promote non-price competition between booksellers in order to promote the sale of little-known, difficult or otherwise culturally interesting books rather than catering only to blockbuster readers. To do so, the FBPA is deemed to ensure that the booksellers that provide the corresponding presale services are able to recoup their higher costs with a guaranteed margin on blockbusters. A related case is the existence of Fixed Book Price Laws (FBPL), where the book prices are kept fixed by law. An example of FBPL is the current Lang Law in France. An FBPA/FBPL, with various provisos, have existed in some developed countries since the beginning of the twentieth century. It remains in force in roughly half the countries of the European Union as well as in some other countries.
  • Die Buchpreisbindung ist die gesetzliche Auflage, eine festgelegte Preisbindung einzuhalten. Sie verpflichtet Verlage beziehungsweise Buchimporteure, einen Verkaufspreis festzusetzen. In Deutschland gilt die Buchpreisbindung im Buchhandel für sämtliche in Deutschland verlegten Bücher (auch fremdsprachliche solange sie überwiegend in Deutschland abgesetzt werden) sowie für Musiknoten und kartographische Produkte. Außerdem gilt die Buchpreisbindung für „Produkte, die Bücher, Musiknoten oder kartographische Produkte reproduzieren oder substituieren und bei Würdigung der Gesamtumstände als überwiegend verlags- oder buchhandelstypisch anzusehen sind sowie kombinierte Objekte, bei denen eines der genannten Erzeugnisse die Hauptsache bildet“ (BuchPrG § 2). Solange es sich nicht um gebrauchte Ware handelt, muss dieser Preis eingehalten werden (BuchPrG § 3). Importtitel, also z. B. aus Großbritannien oder den USA (beides Länder ohne Buchpreisbindung) eingeführte Werke, unterliegen dagegen auch in Deutschland keiner Preisbindung. Verschiedene europäische Staaten haben ein Gesetz zur Buchpreisbindung, etwa Frankreich. Die Rechtslage in Österreich ist weitgehend identisch mit der deutschen. In der Schweiz wurden die Buchpreise nicht durch ein staatliches Gesetz vorgeschrieben, sondern durch eine privatrechtliche Vereinbarung der Verlage und Buchhändler (sog. Sammelrevers). Diese Vereinbarung stand im Widerspruch zum Kartellgesetz. Die Buchpreisbindung fiel im Mai 2007, nachdem das Bundesgericht die Einschätzung der Wettbewerbskommission bestätigt hatte und der Bundesrat hat eine Ausnahme für ein Kartell abgelehnt.
