Maar aangezien er verder van de kant van de platenmaatschappij er geen actie kwam om de band naar een hogere trede te brengen, besloten ze hun managers te ontslaan en al het werk weer zelf te gaan doen. In die tijd besloot hun bassist hen ook te verlaten, deze werd echter weer snel vervangen door de huidige bassist Zack Bates. Met de nieuwe drummer sloten ze een contract af met platenmaatschappij Texax Cries en maakten ze de cd The Bear(2005). Het nummer Broken Promises van hun cd Element Eight(2003) is opgenomen in de soundtrack van het videospel Need For Speed Underground. Nadat de band voor korte tijd uit elkaar is gegaan in 2007 schijnt het dat de band weer bij elkaar is en ook bezig is met een nieuw album dat begin 2008 zou moeten verschijnen.

Utwór Broken Promises został wykorzystany w grze Need for speed: Underground. 5 listopada 2005 ukazał się kolejny album o nazwie The Bear.
