Common Development and Distribution License (CDDL) is a free software license, produced by Sun Microsystems, based on the Mozilla Public License (MPL), version 1.1. Files licensed under the CDDL can be combined with files licensed under other licenses, whether open source or proprietary. The Free Software Foundation considers it a free license incompatible with the GNU General Public License (GPL).

The Free Software Foundation considers it a free license incompatible with the GNU General Public License (GPL). The incompatibility arises from a complex interaction of several clauses that the CDDL inherited from the MPL. The CDDL was submitted for approval to the Open Source Initiative on December 1, 2004 and was approved as an open source license in mid January 2005. In the first draft of the OSI's license proliferation committee report, the CDDL is one of nine preferred licenses listed as popular, widely used or with strong communities. The previous license used by Sun for its free software/open source projects was the Sun Public License (SPL), also derived from the Mozilla Public License. The CDDL license is considered by Sun to be SPL version 2. Die aktuelle Fassung der GPL schließt jedoch die gleichzeitige Verwendung einer Lizenz, die zusätzliche Restriktionen enthält, aus. Auch der Begriff „geistige Eigentumsrechte“, deren Nutzung die CDDL gebührenfrei überlässt, stimmt nach FSF-Meinung nicht mit den GPL-Formulierungen überein. Die CDDL erlaubt die gleichzeitige Existenz mit Code unterschiedlicher Lizenzen nebeneinander, solange dies nicht die Lizenzbedingungen des unter der CDDL gestellten Programmteile verändert. Unter der CDDL veröffentlichter Code darf auch bei Veränderung nur unter Beibehaltung des Lizenztextes weiterverbreitet werden. Die CDDL ist nicht kompatibel mit der GPL, unter anderem, weil die CDDL eine Klausel enthält, nach der die Lizenz ungültig wird, wenn ein Lizenznehmer rechtliche Schritte gegen den Lizenzgeber unternimmt, die sich auf durch das lizenzierte Werk eventuell verletzte Patente beziehen. In diesem Fall erlischt die Lizenz innerhalb von 60 Tagen, sofern die Patentklage in dieser Frist nicht zurückgezogen wird. Dies verhindert auf Grund der Bestimmungen der derzeitigen GPL-Fassung, dass Code, der unter der GPL veröffentlicht wurde, als abgeleitetes Werk in Projekten verwendet werden darf, die die CDDL benutzen. Am 14. Juni 2005 wurde der Quellcode des von Sun Microsystems entwickelten Betriebssystems Solaris durch das OpenSolaris-Projekt unter die CDDL gestellt und somit als Open-Source-Software zur Verfügung gestellt.
