He decided at first instance the case of Hunter v Moss which relates to the certainty of subject matter of a trust. He posited the postulation which was adopted by the Court of Appeal that where the subject matter of a trust to be apportioned from a bulk which had all its constituents to be of the same features (value, kind, etc), then such a trust should not fail for want of certainty of subject matter where it was adequately quantified. In September 2007 he became a Lord Justice of Appeal, on the retirement of Robin Auld.
