But on October 19, 2000, Nicastro was arrested and extradited to the state of New Jersey, where more than 50 of his associates from the DeCavalcante crime family were put on trial for various criminal activities, including labor racketeering, extortion, loansharking, illegal gambling, murder and conspiracy to commit murder charges. Nicastro, then in his mid 60s, was convicted of predicates under the Racketeer Influenced and Corrupt Organizations Act, and was sentenced to 8 years in prison. As of March 2009, Bernard Nicastro is incarcerated at the U.S. Medical Center for Federal Prisoners (MCFP) in Springfield, Missouri. His projected release date is May 13, 2015.
