- Eine Abmahnung (umgangssprachlich auch "Abmahnschreiben") ist die formale Aufforderung einer Person an eine andere Person, eine bestimmte Handlung künftig zu unterlassen oder vorzunehmen. Grundsätzlich sind Abmahnungen für jeden Bereich zivilrechtlicher Unterlassungsansprüche und in jedem gegenseitigen Vertragsverhältnis einsetzbar. Besondere Bedeutung hat die Abmahnung allerdings im gewerblichen Rechtsschutz, insbesondere im Wettbewerbsrecht, im Urheberrecht und im Arbeitsrecht. Im Wettbewerbsrecht werden 90-95 % aller Verstöße im Abmahnverfahren erledigt. Ursprünglich wurde die Abmahnung als Geschäftsführung ohne Auftrag verstanden, teilweise wurde sie auch als gewohnheitsrechtliches Instrument angesehen. Inzwischen ist die Abmahnung, zum Beispiel in Vorlage:§ UWG, auch gesetzlich geregelt. In Österreich spricht man von einer Unterlassungsaufforderung. In der Schweiz existiert kein mit der Abmahnung vergleichbares Rechtsmittel. Die Abmahnung ist in Deutschland nach Vorlage:§ Abs. 2 BGB ausdrücklich als Voraussetzung für die Kündigung von Dauerschuldverhältnissen aus wichtigem Grund oder für den Rücktritt von einem gegenseitigen Vertrag vorgesehen.

In most cases, the law allows the party sending the letter to demand payment of legal costs associated with the sending of the letter. In theory, this allows anybody that observes a violation of a law that may be covered by an Abmahnung to hire an attorney, have a letter sent, and be reimbursed for the attorney's fees. In practice, a lawyer may do this without having been hired by a client who has been wronged, in essence searching for violators of covered laws and demanding payment from them for having found them. This abuse of the law has in recent years led to the so-called Abmahnwelle (-wave), as lawyers and copyright holders are trawling the internet searching for even minor and usually unintended violations of e.g. copyright law, with some lawfirms sending thousands of letter per year demanding payment.
